This Program is exclusively available to authorized members of the TopGun Flooring management team. By participating in this Program, you agree to be bound by these Terms and Conditions in full. If you do not agree, do not enroll in or continue to use this Program.

1. Program Description

TopGun Flooring (“Company,” “we,” “us,” or “our”) operates a private, internal SMS/text message alert program through TopGunFlooring.com. The purpose of this Program is to deliver real-time digital activity notifications directly to the mobile devices of designated Company management personnel.

Alerts sent through this Program may include, but are not limited to:

• Website traffic events, including new visitor activity, form submissions, and contact inquiries
• Digital marketing campaign performance updates and lead generation notifications
• Online quote requests and customer engagement alerts
• E-commerce or booking activity associated with Company digital properties
• Security or unusual access alerts related to Company online accounts and platforms
• Operational announcements relevant to management decision-making

2. Eligibility & Enrollment

This Program is exclusively restricted to authorized members of the TopGun Flooring management team. Participation is not available to the general public, customers, or unauthorized third parties. Enrollment is granted solely at the discretion of Company leadership.

By enrolling in this Program, you represent and warrant that:

• You are an authorized employee, officer, or designee of TopGun Flooring
• You are at least 18 years of age
• You are the owner or authorized user of the mobile phone number provided for enrollment
• You have the authority to receive and act upon confidential Company communications via SMS
• You will safeguard all information received through this Program in accordance with Company policy

3. SMS Disclosures & Message Details

Required SMS Disclosures

• Message Frequency: Message frequency varies and is based on real-time website and digital campaign activity. You may receive multiple messages per day. Frequency may increase during active marketing campaigns, promotional periods, or elevated website traffic events.
• Message & Data Rates: Message and data rates may apply. Standard SMS and data rates charged by your wireless carrier may apply to each message sent and received. TopGun Flooring is not responsible for any charges imposed by your mobile service provider.
• Opt-Out: You may opt out of the Program at any time by replying STOP to any Program message. Upon receipt of your STOP request, you will be sent a final confirmation message and no further messages will be sent. You may also contact the Program administrator directly to request removal.
• Help: For assistance with this Program, reply HELP to any message or contact the Program administrator at the information provided in Section 12.
• Supported Carriers: Most major U.S. wireless carriers are supported. Carrier support is not guaranteed. TopGun Flooring is not liable for delayed or undelivered messages.

4. Confidentiality of Information Received

As an authorized participant in this Program, you will receive communications containing sensitive, proprietary, and confidential business information belonging to TopGun Flooring. This may include customer contact details, lead data, website analytics, marketing performance metrics, and other non-public Company information.

Confidentiality Obligation: All information received through this SMS Program is strictly confidential and is provided solely for internal management use. You are prohibited from forwarding, sharing, reproducing, screenshotting, or disclosing any message content to any unauthorized person, inside or outside the Company, without express written authorization from Company leadership.

Breach of confidentiality obligations may result in disciplinary action, termination of Program access, and/or legal remedies available to the Company under applicable law.

5. Privacy & Protection of Contact Information

In the course of this Program, you may receive customer-submitted contact information, including names, phone numbers, email addresses, and service inquiry details. This information is transmitted to management for the sole purpose of facilitating timely business responses.

Contact Information Security Requirement: All customer or prospect contact information received via this Program must be treated as strictly private and secure. You may not use, store, copy, or distribute such information outside of authorized Company systems and workflows. Contact data must never be accessed for personal use or shared with any unauthorized party.

TopGun Flooring is committed to protecting the privacy of all individuals whose contact information is processed through our digital platforms. Management participants in this Program serve as custodians of that data and bear responsibility for its lawful and appropriate use.

6. Mobile Number Non-Sharing Policy

TopGun Flooring will not sell, rent, lease, trade, share, or otherwise disclose any participant’s mobile phone number to any third party for marketing, commercial, or any other unauthorized purpose. Mobile numbers enrolled in this Program are used exclusively for the delivery of internal management alerts as described herein.

Mobile numbers will not be shared with external vendors, advertising platforms, data brokers, affiliates, or any entity outside of TopGun Flooring’s authorized communication service providers, who are contractually bound to protect your information.

7. Data Security & Transmission Standards

TopGun Flooring employs industry-standard security practices to protect the integrity and confidentiality of data transmitted through this Program, including:

• Secure transmission protocols for data passing between our website, digital platforms, and messaging systems
• Access controls limiting Program enrollment and message delivery to verified management personnel only
• Periodic review of enrolled numbers and access rights to ensure only currently authorized personnel remain active in the Program
• Use of reputable, compliant SMS communication platforms that adhere to CTIA guidelines and applicable telecommunications regulations

While we implement reasonable safeguards, no electronic communication system is entirely immune to interception or unauthorized access. Participants are responsible for securing their own mobile devices and ensuring that Program messages are not accessible to unauthorized individuals.

Device Security Responsibility: If your enrolled mobile device is lost, stolen, or compromised, you must immediately notify the Program administrator so your enrollment can be suspended or transferred to a secure device.

8. Acceptable Use

Participants agree to use the Program solely for its intended purpose of receiving and acting upon internal Company alerts. The following conduct is strictly prohibited:

• Using Program-delivered information for any personal, commercial, or competitive purpose outside of authorized Company business
• Sharing, forwarding, or republishing any Program message or its contents on social media, public forums, or any external platform
• Attempting to intercept, redirect, or manipulate Program message delivery
• Enrolling a mobile number belonging to any person who has not been authorized by Company leadership
• Using Program access to gain unauthorized advantage over colleagues or competitive parties

9. Intellectual Property

All content delivered through the Program, including but not limited to business data, marketing analytics, campaign results, customer inquiry details, and operational reports, is the exclusive intellectual property of TopGun Flooring. Participation in the Program does not transfer any ownership rights over such content to the recipient.

10. Limitation of Liability

TopGun Flooring provides this Program on an “as-is” and “as-available” basis. To the maximum extent permitted by applicable law, we are not liable for:

• Delays or failures in message delivery caused by wireless carrier issues, network congestion, or device compatibility
• Any loss, damage, or unauthorized disclosure resulting from a participant’s failure to secure their enrolled device
• Inaccuracies or errors in automated alert data generated by third-party analytics or tracking platforms
• Any carrier-imposed message or data charges incurred by the participant

In no event shall TopGun Flooring’s liability arising out of or related to this Program exceed the amount, if any, paid by the participant in connection with Program enrollment.

11. Modifications & Termination

TopGun Flooring reserves the right to modify, suspend, or terminate this Program, or any participant’s access to it, at any time and without prior notice. We may also update these Terms and Conditions at any time. Continued participation in the Program following any update constitutes acceptance of the revised Terms.

The Company may revoke a participant’s enrollment at any time if, in the Company’s sole judgment, the participant has violated these Terms, left the management team, or no longer has a legitimate business need for Program access.

12. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising out of or in connection with this Program shall be resolved exclusively in the state or federal courts located in Texas.
